1) Scope of application
The following conditions apply to the use of our services and orders.
2) Registration and use of accounts
2.1 Use of our services does not necessarily require the creation of a user account with us. However, you have the option to register to use GPT-4, for example. Registration is free of charge.
2.2 You are responsible for all activities that occur under your account and you agree to keep your password secure and not share it with any third party. If you become aware of any unauthorized use of your account, you must notify us immediately.
3) Contracting party, conclusion of the contract
3.1 The purchase contract is concluded with (GULL AG - Käferholzstrasse 261 - 8046 Zurich - info@gull.ch).
3.2 With the availability of token packages on our website, we make a binding offer to conclude a contract on these products. The contract is concluded when you click the PayPal button to purchase a voucher package and confirm the purchase on the PayPal page. By confirming the purchase on the PayPal page, you accept the offer. The same applies to credit card and TWINT payment methods.
3.3 Please note that the final agreement of the contract also requires the successful completion of payment by the payment method used by you. If the payment is not successfully completed for any reason, the contract will be deemed not to have been concluded.
4) Contract language, storage of contract texts
4.1 The language available for the conclusion of the contract is German.
4.2 We store the contract text and provide you with the details of your token purchases. You can view them on our platform under the "My Account" menu option, where the details of each purchase are listed, including the number of tokens, amount paid, payment ID, status and date of purchase.
5) Digital products
5.1 Our products are exclusively digital tokens that can be used to use the GPT-4 model on our platform. Upon payment, the corresponding tokens are credited to your account in real time.
6) Conditions of use
6.1 Purchased tokens may only be used for the purposes indicated on our platform. It is not permitted to transfer or sell the tokens to third parties.
7) Expiry of tokens and accounts, as well as cancellation of accounts.
7.1 In order to ensure the efficient administration and maintenance of our platform, we reserve the right to delete unused accounts and tokens after a period of inactivity of at least one year. Tokens lose their value upon termination.
7.2 This is done in order to use our resources efficiently and to ensure that users cannot reclaim their unused tokens after a significant period of inactivity. We recommend that you regularly log in to your account and use your tokens.
7.3 You have the right to delete your account at any time. Please note that deleting your account will irrevocably delete all data stored in your account and the tokens you have purchased.
7.4 We reserve the right to delete your account and terminate your use of our services if you breach these Terms and Conditions or if we become aware of any improper or illegal use of your account.
8) Changes and termination of services
8.1 We reserve the right to change or discontinue our services at any time, including, but not limited to, in the event that our cooperation with OpenAI or any other service provider is terminated or due to circumstances beyond our control.
8.2 In the event of a material change to or termination of our Services, we will endeavor to notify you in advance and will take all reasonable steps to minimize the impact on you. This may include, depending on the circumstances, refunding all or part of any remaining balance of Tokens.
8.3 However, we do not warrant or accept any liability for any change, failure, interruption or termination of our services, and we cannot guarantee that we will be able to provide refunds or other forms of compensation in such cases.
8.4 In the event of termination of the Services for reasons beyond our control, we will endeavor to refund the remaining balances of the Tokens to the best of our ability. However, we cannot guarantee full reimbursement.
9) Prices and payment terms
9.1 The prices of our products are indicated in the product description and include VAT. Currently, payment can only be made through PayPal.
10) Warranty
10.1 The warranty is provided in accordance with the statutory provisions.
11) Modifications to the General Conditions
11.1 We reserve the right to change these Terms and Conditions at any time without notice. Any changes will be posted on our website. Your continued use of our platform after such changes constitutes your acceptance of the revised terms. It is your responsibility to check the Terms and Conditions periodically and to inform yourself of any changes.
